Fulton Homes

In March my husband and I entered into contract with Fulton Homes to build a home in Gilbert Arizona where the construction delivery date was estimated some time between September and January . We subsequently put our $4,000 earnest money down to begin progress on the home. On June 12th my husband received orders to report for duty in Washington DC for his next military deployment. On Monday June 15th we were advised he needed to report for duty no later than August 3rd. After receiving this notice we contacted the builder and asked for a contract cancellation form and advised of the nature of the required return of our deposit under *** section 532 protecting us from losses due to military relocation orders. Instead of compliance with this regulation, the sales agent sent a cancellation form indicating we "changed our mind, no refund". I responded to the email that we would not be signing anything of that nature as we are entitled to our deposit back. The sales agent has indicated that they will not be providing any refund and that our military deployment status will not be recognized.
