unfair business practices
I went to check the balance on my checking account and noticed that it was -850, 000 dollars. I called customer sevice and it turned into 1.5 hour and 5 different people telling me they couldnt understand it. I finally got ahold of someone from the fraud department that said the bank decided to end the relationship based on something from my credit report. I was never notified of the attempt to close my account and now i have to go without my funds (over 5000 dollars) for 15 days to process the closure. I have been a loyal customer since 2005 and this kind of business practices people should start paying attention and let everyone know never to use this bank. They obviously do not care about the individuals that made them to what they are today.

house insurance proceeds
Bank of America ripped me of legally!
I complained to them so many time, but never heard from the, the survey that they send you is just a bogus one, i put
my email address, phone and name for somebody to contact me, but they never did.
I lost my house in a national disaster, After the insurance paid me, i had to give the check to the bank (at that time
Countrywide), they gave me 1/3 of the proceeds to start rebuilding, and told me the 2nd and 3rd proceed will follow
when i started. Bank of America bought Countrywide. after that they gave me so many problems for issuing checks, that i
had to borrow money from family and friend to get my rebuilding going. They kept more than $160, 000 of my money in a so
called escrow account for more than a year and paid me less than $3 interest on it and at the same time were charging
6.5 percent interest on my mortgage! I wanted to pay off Coutrywide at first and when it get the time to rebuild get a
construction loan with a much lower interest rate on the money that i was getting, not the money that i would be
getting! But Countrywide promised that their payment would be very easy and I shouldn't mess with it. That wasn't the
case when BOA got the loan. Anyways I lost more than $15000 in interest alone. Not to mention that every time BOA sent
me a check, they would put a hold on it at BOA, on their own check! Once I got a check for $10, 000 and took it to BOA
in Camarillo and wanted to cash it, the would give me just $1000 in cash! They said I should have called three days in
advance for getting cash. Can you believe it? I do have the name and days of all these incidents. But nobody listened
to me, ever. So my suggestion to you, if anything happens to you house, and you get a check from insurance, payoff the
bank, so you don't have a mortgage payment interest for a house that you don't have for a year or two when your are
rebuilding. I don;t know who are these lawmakers that make law for consumers that require them to give their insurance
proceeds to the bank, and not to get any interest on it, but at the same time pay interest for same money as mortgage
to the bank, and go through so much hassle and beg for your money that the bank is keeping! In a so called escrow
account ( supposedly the bank cannot touch the money, give me a f..break!).

All Im saying is I cash checks for 10-20k about 2 times a month.. never have issues, they have to make funds available if the check is drawn on their bank. (I did one time have to wait 24 hours for them to get more cash but that was the never repeated)
holding payroll check for extended period of time
My husband was in the middle of switching jobs and we had just enough to get by and after $300 in overdraft fees (mind you they cleared 9 transactions the same day that had been pending anywhere from 1 day to 5 days under $6.00 each which made us go wayyy in the red) my husband finally gets his first paycheck from his new job.. $1, 200. Direct deposit won't be starting until next pay period..
On August 8th we go to the ATM to deposit it, finally relieved that we can get our balance back to zero and get some bills paid and best of all, eat.. The ATM gives me a reciept and I look in horror when it says funds are on hold until the 19th!
I get home and call the bank and demand that they either release the hold or return the paycheck and they say there's nothing they can do. Our electricity got cut off, we had no groceries for 4 days and my husband is a truck driver so we was out on the road for a week and a half with no money for food... By the time he got his pay from them they had charged us another $70 in "extended overdraft fees" and "insufficient funds" fees totaling $140.. Surprising how they didn't decline any incoming charges UNTIL my husbands paycheck was "pending."
When all was said and done $525.oo of my husbands $1, 200 paycheck went to the f***ing bank, because of all the overdraft fees and it was all because they decided to hold the only money we had hostage.. I wish we could file a lawsuit but there's no way we'd ever get anywhere.. It's wrong, unethical and they deserved to be in jail for stealing hard earned money like that.
I have been out of work since Feb 2010 getting unemployment every week. I told Bank of America my situation, as if they cared, on several occassion I have went into the red on my account. I don't like bank fees, no one does, after Bank of America charged me 35, 00 for insufficient funds, I received what they called an extended fee of 35.00 and was told this would continue until a deposit is made into the account. This is an unethical practice i have ever seen. Bank America is a big thief! Everytime I see a Bank Of America ATM on the corner, I think of the atm has stationary thieves of Bank America on every corner! I hate banks period! I'm moving to the credit union!
benefits I have paid for 6 years
To all:
Bank of america fraud of benefits
I filed for the cardholder security plan with bank of america.
This service I have paid for the last 6 years.
Now after being laid off in april 2010 I activated the benefit was approved for 15 months.
I have been not only been faxing one of the benefit managers of the benefit department directly the paperwork required each month but have also sent a mailed copy to the benefits department with a tracking number.
I phoned to follow up on the status of my benefits and the representative informed me the paperwork had not been received... So I faxed and call to comfirm receipt of the paperwork.
Now I receive in the mail a notice the maximum number of payment cancellations has been reached... What? Really and at the end of this notice thank you for being a valued customer...
I had changed my morgage to another bank and will never engage in any finicial activity with bank of america. Personal or business accounts. When I return to the corp world I will never recommend bank of america or use the for any corporate business.

very bad cust. service
I filled out an online application for a new mortgage and got pre approved. The problem started after i received the packet from them. I sent all the documents as requested. They started questioning about some transactions that I had made in the last few months. I tried to get the documents for that. They said they were not satisfied with them. Finally they said all is fine and that they needed a "signed letter about my birth date". Seriously, i asked after I had sent them a copy of my dl, my passport and my birth certificate. I sent it anyways.i did not hear anything at all until i asked my agent to call about 36 hours before closing. They came back saying now they had a problem with the appraisal. the same appraisal company that they had asked to do After i had asked my loan officer about it and he had said everything was fine. Then they said they will do an emergency appraisal the next day so that i could have my closing on the day scheduled. NOTHING, NO ANSWERS. I had to extend the closing. I finally decided to apply with a local bank.(they got it approved within a month as promised). Anyways later when i call them to cancel my loan app. the manager says that it is in review and that I should get the results within a few days. A week went by with no answer. After i got my loan approved with the other bank, The same day i get a call from a lady saying she will be my new loan officer. I tell her she is the fourth person that is handling my case withing the last month and that i have got my loan approved through another bank and to stop wasting my time and their underwriters time. I have been a customer for them for 7 years and the only reason i went with them was thinking it would be easier since they would have my records and financial statements. It has been really ridiculous, Especially"signed birth date letter". even they did not know what they wanted when i asked. they asked me to write a letter saying i am so and so and that my date of birth is such. I am going to be taking my business somewhere else after this type of service.

total confusion and mahem
Description of complaint:
would you like to hear about how they are making money off supposedly helping people with "Home loan modification" programs? Trust me this is as concise as I can be; A year ago I asked to be late on 1 payment due to a change in my pay period. They signed me up for a loan modification through the "Keeping Home Affordable" program and told me I qualified in the first phone call and that it would lower my payments, I said OK and they said my packet would be there in 6 weeks. That was a year ago, after a year of me continually calling them (I could not even tell you how many times I called and how many people I talked to... all the way to the CEO's office!) I kept sending them money each month even though I was told I didn't need to by some and told the opposite by others. My online accounting (my only source of information on my account)did not show my payments made until I raised hell last fall and then some were all credited on the same date and they still were not labeled payments but MISC, I have filled out the loan modification papers and documentation twice without any confirmation of receipt except from UPS, and still there is no record of the money I have sent them since and the modification is still not complete. I have called my " so called workout negotiator- Terrance Holt" uncountable times, you cannot leave a voice mail it routes you to a customer service rep. who knows nothing! After a some random sleazy guy showed up at my home and handed me a hand written slip of paper telling me to call BOA Home Loans about my foreclosure (what?).. I finally kept calling till the "workout negotiator- Terrance Holt"answered his phone extension last week and he told me he had "closed" my loan June 30th, I asked why my online record still showed me in still in arrears and my payments are not posted and WHERE IS MY MONEY GOING? he said it was in a "special account" I could not see!. Every time I talked to someone (including the CEO's office) I asked for written documentation of what they were telling me and they would say they could not provide that, I would ask for their email address and they could never give one. My credit reports shows me as not having made a payment for a year! My questions; Why couldn't I just be late one month? Where is my money that I have sent almost every month for a year?(the only time I did not send a payment was the months immediately following my "approval of my app" and was told NOT to) the answer must be that they are making money off this process...Who is making money off my money? How is it possible that at the end of this process, I owe MORE than I did when I bought the house 2 years ago? Why can't I get a straight answer in writing? When am I going to get to see in chronological order penny by penny, what has happened to my account? Who is going to fix my credit report? I am sending this to the CEO's office and to a consumer advocate, I think they BOA count on we consumers being ashamed of our financial situation and not wanting to complain, well I am DONE with that. thanks for listening
I am going through the exact same thing with Making Home Affordable program through B of A. I went through a divorce about a year and a half ago and bankruptsy. I have owned my home a little more than 4 years and and always paid my mortgage on time. I applied for modification back in October 2010 and was pre-qualified for the loan over the phone. I was asked to send documentatation and I did. They replied and said I am missing some documents, and i sent it again and also faxed all the documents. I called after a week to confirm and was told that my documents have been received and is being reviewed. Then I got a letter stating that they declined my request because I did not provide them the documentaion on time. I called and told them that I have proof of everything and they said they can appeal it and reopen the process again. I called to check again and they told me everything is looking ok. When I called to check a week ago to check my status, I was told that my application was denied because they were not able to get a hold of me to discuss payment options, eventhough I did not receive a phone call from them regarding anything. The only thing I have received from them is a letter to update my contact information. When I have told them that I have not received any phone calls from their office, they said I have to appeal the deceision but I can not start the appeal process without receiving a decline letter from them. The day I received said the letter, I called them and and asked them to reveiw my case and I was told by a very rude, diserespectful young lady (Andrea ID # 6728) that I can not appeal the deceision no matter what and hangup the phone on me. I am a responsible, single mom who is working hard to keep my family going and supporting my children. My situation is not due to irresponsibility, but due to something I have no control over. These people are trying to frustrate everyone so that you can give up and loose their house. I will fight and do everything I can to keep my house and also get some legal assistance. This is not fair!
the exact thing is happening to me it has been going on a year now. I have involved HUD and FANNY MAE they still are doing this stuff. who do we go to to hold these people accountable. They are deseptive and try to cofuse you They will say you do not qualifie for the Barack Obama making homec affordable program but read it closely because they manipilate the caculation. Then try to put you into BofA's affordable home program which is totally different and does not follow the rules. They will confuse you to think you are getting the Obama program until you pin them down to give you a answer. Someone has to hold these people accountable. I hear that because I live in California I might be in luck . I was a former Countrywide home loan and Bof A took it over mine is a Fannie Mae but they lied to Fanny Mae. I to have them not showing payment on my credit report. I get intent to forclose letters all the time what I do is go through HUD and have them on the phone when I call and let them speek for me that way everything is documented with HUD also with HUD so I have proof .
I suspsect that what Bank Of America is doing is collecting the money from the government to assist homeowners, then finding a way to forclose on the house for some made up technical reason. If the house is Fannie or Freddie insured, they collect the money from the government for the loan. I appears that they have figured out a way to mainipulate the system to get paid on both ends.
I received a so called modification from BOA last year due to medical disability...my payments went from $800 down to $460. I was told that this modification would be permanent, that I would still owe the full amount of $159, 000, but the terms would be longer and interest lowered.
In less than one year they raised my payment back up to nearly $900. Why? They said it was due to a change in the interest.
When I asked about the rules that state that the modification was to be 31% of my income, they just kept saying that it changed due to the ARM changing with no clear explanation. They also said I could not request another modification.
Basically, the 31% income rule is not accurate, my payments are higher than they were before the modification, and I will be homeless soon...literally, I have no where to go, credit is ruined, my pets are out. This modification is devastating.
loan modification
MY bank promised me over the past 2 years that if i made 3 payments on my loan mortgage, my loan modificaiton approval would arrive in the mail (this was last year) here i am waiting for those papers 1 year later, they recently gave me the same promise, this time I asked for written request for this in the mail, so far they have done nothing.
My first morgage gave me loan mod a year ago and RAISED my payment, thats another story

bank of america's inept, ruthless collection tactics
Bank of America used Northstar Location services to collect on a bad debt for a customer who had the same name as my husband and lived in the same state. After they called my 72 yr old mother-in-law and told her she was stupid, I called them to put a stop to it. They told me that I was a bad mother and needed to get off the phone, leave my dead beat husband, and take care of my kids. They then called my husband who left work to handle it in person with the only BOA branch he has ever dealt with. The branch manager called the collection office to tell them they had the wrong man, but things continued to spiral out of control within the next few weeks.
We pulled my husband's credit reports and found a lot of cross reporting with this other man. BOA was the only bank that the man and my husband both did business with. We disputed all the incorrect information. Yet, BOA sent us letters saying they had been notified of our bankruptcy by Transunion (we have NEVER filed for bankruptcy, and when I immediately requested a copy of my husband's Transunion credit report, everything was fine). However, once BOA mixed their information of my husband and the other man, suddenly, my mortgage company and the company we had our truck loan through contacted us about our supposed bankruptcy. Many hours were spent proving our identity with all three credit bureaus, and everyone we did and did not have credit through. We put freezes on everyone's credit in the house, disputed all inaccuracies with the bureaus, and we closed our savings and checking accounts and our credit card with Bank of America. The last credit reports we pulled were totally correct.
That was almost two years ago. Recently, we wanted to refinance our house and lifted the freezes on our credit to do so. Immediately, my mother-in-law was called by BOA, and though our credit reports were great with scores of the upper 700s and lower 800s, my loan officer asked me about a "judgment pending" on my mortgage. She could see no reason why there had been such a thing and needed to get my mortgage company and BANK OF AMERICA on the phone. I hit the roof. Why would we ever need to talk to Bank of America? My mortgage company says they have no idea what is going on, and BOA says the same. What the heck is going on? I pulled all 6 credit reports before we lifted the credit freezes, and they were completely correct. BOA needs to be smacked with a class action lawsuit!

My husband died & I lost 60% of our income. I can't sell the house for even half what we owe. I have asked for a modification & they turned me down. OMG! I am going to just stop making payments. I have never defaulted on anything in 62 years of life. They got a bail out from my taxes but won't give me the time of day to resolve this. My husband was a veteran of 2 wars & 24 years in the military. They just don't care. So screw them. If I live on the street, it won't matter to them. ###!@!
This MF bank did the same thing with my 90 yr old dad, calling him day and night. Threatening him for a debt that was not his. They were looking for someone with the same name but different age. The orig. debtor was 39 and last address was in another town. My dad kept verifying his birthdate with them but nothing.
It wasn't till I stepped in and threated to sue them and filed a complaint with the state attorney's office did they stop calling. And if I would have known better at the time should have taken them to court too and gotten a jefty sum for false accusations and harrassment.
This bank uses illegal tactics for all their dealings. Their new CEO has been charged with racketeering. The other one had to step down for all the horrible things he did. What else is new for this bank.
Stay away from this bank, do not use this bank for anything and if you have an account with them close it and run. And do not be intimidated with them if you get harrasing calls from them, simply file a complaint and take them to court . They are lawyers who can take your case and get paid from what BOA has to pay you. And you also get compensation. They are not above the law, acting like the mafia.
And sick2death asap file a complaint against them with your states attorney's office and get a lawyer and take them to court. You have a legal and valid case.
illegal fees and charges
God. Bank of america sucks. They are awful... I was charged four fees, totaling $35 each, which are still processing, and they claim they cannot reverse until tomorrow, to see what my "relationship" is with the bank. (I have been a "client" since 1992!) I am going to my credit union this friday to open up an account there.
Bofa has uniformly been awful. The customer service has always sucked, they hire kids who could not care less, and who no doubt have no problemo working for such a corrupt company. Everyone who has accounts here should do the same as myself - go to your neighborhood bank and open a new account!
Do not give your money away to these crooks any longer...

If you are not successful in getting your loan modification you might be interested in getting a refinance through this group. You must be 125% upside down, late on payments and credit does not matter. They get you a true principal reduction and your total PITI is not more than 40% of your income. If the numbers work and you can prove your income even if you are self employed you can do a P&L statement and show bank statements of deposits you can qualify!
I have been in a battle for 3 yrs with my mortgage company to get a modification. I got no where then I found these guys online and I have never been happier that I did!
Good luck!

abusive banking practices
A Bank of America branch closed one of my checking accounts without notice, because a few of my customers bounced checks in a recession. Suddenly, my own checks began to bounce, because BoA withheld the $229, 912.37 that had been in the account. I could have stopped writing checks had I been informed immediately – but I first learned of the closing in a letter that arrived several days after.
Bank of America then closed two more of my checking accounts, calling me a “bad risk” – though my credit rating is quite good. Again, I was informed late, my checks were labeled NSF, and I was charged fees, while the bank withheld about $270, 000.00 from these accounts.
To date, Bank of America has returned only less than half of the monies it withheld. For several weeks before, BoA denied me information about my accounts by telephone, cancelled my online banking access, and repeatedly refused to say when I could get my money back.
Were the fees charged for the bounced checks not enough? Did Bank of America have to damage my credit report by labeling my checks NSF, while withholding my money and profiting from it, to my company’s impairment? That is dishonest business, based on a lie told about my finances.
This is more than inconvenience and expense to a business: it is a major disruption to its cash flow, and costs it accounting and managerial time. It is needless punishment, damaging a business under a vindictive cloud of secrecy – a cloud under which Bank of America has unethically, and hypocritically, profited.
How can Bank of America be so inconsiderate of the precarious state of American business, on which banks depend? The government has bailed out the banks, even though they had used their accountholders’ money to buy the political influence to secure the deregulation that allowed them to invest in subprime mortgages. The banks reaped heavy short-term revenues, and the doomed loans left the taxpayer, the investor, and the small businessperson to pay when they defaulted.
Arrogantly, BoA is now attacking customers like me to make more short-term profits, as that same paid-for deregulation allows banks to impose destructive fees and penalties on their accountholders. Despite all the bad press and public animosity earned in the last year, banks will go on abusing us so long as they are permitted free rein by government and banking authorities – and by the press.
scam victim check fraud
Bank of America did not protect me and my account. Unfortunately I was a victim of fraud and fell for the online Receptionist scam. I did a few tasks as required, and even looked up and contacted the bank that the cashiers check was from. They told me that they could not verify funds but that it was a guarantee the check had funds if it was from their bank and in cashier check form.
Now I have been with Bank of America since i was 16. I am now 23 and have ALWAYS had my account in good standings. Assuming Bank of America's teller's are trained to recognize fraud and or the process to protect "one" from fraud, I was confident that they would protect my security. When I went to the bank, the young lady placed no hold (which is what usually happens when I deposit or cash any checks with them) on the check and believe it or not cashed it and handed me the money right there and then. I was kind of shocked due to the amount of the check and guessed that she was familiar with that bank. Either way I figured $2500 is a lot of money and questioned the security of the check and if it was possible that this could come back to me for not placing a hold to verify funds? She told me it was not necessary. So like a fool I sent the money away to some other state and was totally scammed. About five days later I went to take out some money and the teller assisting me tells me that my bank account is overdrawn and I had a negative balance due to the check coming back as fraud. Immediately I spoke the manager and she went on to tell me i was like the 5th person this had happened to that week.
So not only did they not protect me they totally screwed me. Manager gave me some phone number to call in regards to "paying" the balance. When I called to explain what had happened it was totally irrelevant and if I did not pay the balance in full within 20 days, they were going to close my account and I would not be able to open an account anywhere for 10 years! This horrible incident may have been my fault for falling for the scam, but I was very upset with the lack of protection I got from B of A. I feel they are to protect me and the didn't. I called the police, filled a report, reported to the FBI because this guy sent me another check. I wanted them to pursue contact with him and try to catch him and or do whatever they could and they told me "hopefully you learned your lesson and won't fall for it again, unfortunately we can't help you".
Example: My father fell for something similar and took a check to B of A, Santa Rosa location (next town over where he lived) and right away the teller that was assisting him told him the check was fraud. Did I get the poorly trained teller or what? I'm so confused as to how the bank allowed this to happen. If anyone has any advice as to how I can help myself your emails are totally welcome. And please no negative comments. I already realize how idiotic I was to even fall for such a thing.. [protected]@yahoo.com

extremely high interest rates
Walter S Westberry no longer even uses this FIA card and is being billed 24.99% interest monthly and charged interest on balance transfers, cash advances that are not even being used. $214.99 interest on balance transfers and $12.04 for cash advances.
We are paying more than the minimum payment each month but with $229.44 monthly interest, we may never get it paid off. I think someone should do something about this high interest rate we are being charged and not even using the card at all, just trying to pay it off. It is not fair to have worked all our lives and then being saddled with enormous interest rates that they absolutely REFUSE to reduce. What can be done? I have already complained to my senator in SC and also lodged a complaint online about this. Tell me what can be done, and DO NOT tell me to go to credit counseling.
The complaint has been investigated and resolved to the customer’s satisfaction.
My husband had a FIA card for 19 years. For reasons unknown, he was ratejacked years ago to 27% interest. We of course stopped using the card. He called to see if he could get that rate reduced to be more in line with his other cards. They refused and DH cancelled the card.
His FICO scores are all above 800. If he doesn't qualify for decent rates who does?
FIA Card Services conduct business if a poor fashion. They charge exorbitantly high interest rates and the highest allowed yearly fees allowed. I made a mistake by allowing myself to do business with the. Warning... never do business with this unscrupulous credit company. They will bleed you dry.
What are the avenues available to a consumer who was charged these rates, agreed to a settlement but was given a 1099 for forgiveness of debt for the entire amount even though he paid more than seventy percent of the outstanding balance?
Help
I have received 5 phone calls from FIA card for $50.oo in late payment charges, that they say they never received-and this is in one day. Also their APR went up to 24.99% which is outragios, but they never contacted me for this-when I called them they hang-up on me after hearing my complains. I am now wondering what I got myself into and dont know where to start. I know I need to pay off my balance and just get the hell out of this deal;but the problem is that I just recently got layoff and have no time to deal with this people.
I have been dealing with company for awhile. I have 3 credit cards with due to merging of companies. In one day, I recieved 4 phone calls from them in one 1hour. I have asked that they stop contacting me on my job. They have yet to sease. I am currently typing a letter to this company including laws in which they have broken. I know that it will not do any good but I will also send a copy to the FTC.
I opened a VISA at Bank of Hawaii 26 years ago. A few years back they sold their accounts to American Express who gave it to FIA card services to manage. I never used the card a whole lot and always had good interest rates. In August, 2007 we needed a new air conditioner and I used one of their convenience checks with a "guaranteed" 7.99 percent interest rate to pay the bill. Since then I've been paying it down on time and over the minimum to arrive at today's balance of $2987. I opened my new bill today to find that my "guaranteed" rate had been jacked up to 15.99%!
The reason? A direct quote from the idiot rep "You've been in pay-down mode for some time so we just decided to make it official."
Are they out of their minds!?!?!?
I'm sending off a furious letter to my congress critters today DEMANDING that they support the FTC Act to curb deceptive trade practices by credit card companies (see http://federalreserve.gov/newsevents/press/bcreg/20080502a.htm).
Credit card companies are no better than highway robbers and they all ought to be hung at the crossroads.
nsf charges rip off
On June28 I accidently sent $1, 736.00 to the gas compay via Bill Pay instead of $17.36. The gas company recongized it as an error and immediantly sent it back. BOA sent it again. The gas company sent it back again. The bank charged me 5, yes 5 NSF charges of $35.00 each and a $10. returned fee. Totaling $175.00 in fees. I was declined my request for waiver of partial charges without an explaination or notification of denial and had to spend over 20 minutes on the phone just to find out the outcome.
It used to be that way!
Will someone please contact me if there is a class action lawsuit filed against Bank of America for the way they handle their online banking and overdraft fees?
Thank you
I have been warning pople about BOA shaky business practices for a long time. Maggie says they cant charge if you dont overdraw. Someone sent me a bad check I deposited unknowingly. BOA charged me fees without explaining what they were for of every penny left in my account . Closed my account and told me that after 8 years they no longer wanted to do business with me. My mortgage was not paid or my electric bill because of their fees. When I tried to talk to someone and explain how was I supposed to know the check was bad until deposit. They did not care. I tried to explain I put it in savings account and chose not to touch until it went through, Again no response and my attempts to have the money that was already in my checking account returned to me I was simply told your account is closed.
A similar thing happened to me a couple of years ago. I got rejected as well. UNTIL, i went in to my local branch. After much discussion and quite frankly me having a complete meltdown for my mistake that cost me$350.00 0 NSF changes, they refunded them all. Try going to a location near you, if certainly couldn't hurt. Good Luck.
accounting errors on mortgage
I received notice in March that my loan had been assumed by BAC. I did not receive a statement from them in April so I called and was told that the loan was paid off. Obviously a computer error. The next time I called to try and make a payment I was told that I could not make a payment as the house was in foreclosure for non-payment for 14mo. After many phone calls, I was told that my previous lender had filed bancrupcy and that it was not BAC's fault that the government had not released the records. I finally got them to accept bank statements as proof of payment. In the meantime, I gave them the equivalent of 3 months of payments while they figured out what I exactly owed. In the meantime, I started the modification process. Today I received requests for additional documents for the modification and taped to my door was the notice for sheriff's sale. They won't ley me make payments! They won't tell me what I even owe! How is this all legally possible? Who governs them? Who can I talk to? I can't afford an attorney and still risk losing my home!
THE WORST BANK IN THE WHOLE COUNTRY.
credit card services
They are simply cruel & unusual. They are also disrespectful and impractical (they hurt their own business with their foolish ways). Why any company would just shut down people's credit card accounts on grounds they are overspending is silly as they are hurting their own dividends from finance charges. Obviously, if ones credit report shows 100% success with paying off loans and balances over time they should leave that customers' credit card alone! This is why their performance as a company is lackluster. If I were the CEO of this company I would really figure out which manager in that FIA card services is telling the employees' there to be some kind of "credit hero" where they close all accounts if the customers revolve debt. Um..hello? Customers' who revolve debt and successfully pay them off over time are the people who generate the banks' income FOOL! Do not do business with them if you want a reliable credit card that won't give you hassle. They are all hassle and they will also demean you as well as HURT YOUR CREDIT RATING if you try to defend yourself. FIA Card services managers are filthy, ignorant swine and should be fired for being so stupid.

overdraft fees theft!
Bank of America Steals your money by using Overdraft fees! They look at a large amount rather then a small amount over a date that was used by debit card transactions. The bank online kept reshuffle my checking account balance online. I was very careful with my check book balance and post down what I used with my debit card. On Sunday, I had a positive...

The so-called "Claims Department" at Bank of America is a complete joke. After I filed a checkcard purchase dispute, they sent me a letter with a copy of the transaction from the credit card terminal stating that the charge was legitimate (which it was not). So, I did the investigative work on my own-wasting several hours on the phone and doing follow up...

In March of 2010, I was paying my bills on time, I was struggling to do this and often borrowing from my adult daughters to get me through the months but I was doing it. Then I decided to see if I am eligible for Make Homes Affordable Loan Modifcation Program (HAMP) that the President has pumped money into banks laps so they can do this to help people like me. It turns out, I am eligible. I turned in all of the required paperwork on time. Everything is going like plan. I am "in Review" still. It is almost July. The problem? Other than the ridiculous wait? As soon as they took my application they established an escrow account for my property taxes (that were not delinquent..I never approved the escrow account outside of the loan modification and I wasn't even notified it was going to be done). So this significantly RAISED my house payment. For April, and May, and June and now July. I needed it lowered. I was barely making my bills before I called. Raising my house payment was the straw that broke the camel's back. Bank of America told me I had to pay the full amount...my original payment and teh escrow payment or I would be pulled from the Make Homes Affordable program.
Even my daughters couldn't bail me out of this financial mess, so I missed credit card payments. They charged late charges, added penalty interest rates, doubled payments...now there is no way I can pay them. I called Consumer Credit Counseling and they say the only option considering my housing expense is so high is to go bankrupt. I just can't believe this is happening. I called Bank of America for help. The website says "the sooner you call - the sooner we can help" and at the time I was still treading water and doing okay. Bills were paid. I was eating and able to buy all off my prescription meds. Now, four months later, even though I am eligible for the loan modification - I have a higher house payment, my credit cards aren't paid, I have to pick and choose which prescriptios I buy because I can't afford them all. I feel like I am in the Twighlight Zone. Where's Rod Sterling when you need him? I want him to come out so this episode of bizzare events will end.
This is what American banks have done to America...in President Obama's name. I doubt he would be happy.
Taking forever to close my loan. I been shuffled from one loan officer to another. Takes forever for them to respond to any corespondence. I was supposed to close May 21st. It is now june 10th and still nothing. I am now homeless living in a friend's living room because I had to move out of the place I was renting. Terrible, terrible customer service.
Bank of America and its President, Brian T. Moynihan, and one Robert Flores who says he's "from the Office of the President, Bank of America" are arrogant ###s totally out of touch with the rest of us Americans. Case in latest point is that I go to my local Senator's office for help under this HAMP, BUT the arroganr ###s, Brian T. Moynihan, and Robert Flores, leave me a telephone number I have to pay to call them at. [protected]. Zero customer service. Zero brains from Bank of America's Brian T. Moynihan, and Robert Flores. Bank of America takes billions of dollars from each and every one of us taxpayers but won't have an 800 number in Bank of America's President's Office to handle these loan mods coming in from the Congressional offices or even their customers. If I could afford long distance, you arrogant totally out-of-touch ###s Bank of America's Brian T. Moynihan and Robert Flores, I wouldn't be trying to get this legally required loan modification from Bank of America now would I?!? No wonder we tax payers had to bail Bank of America out!

short sale/unprofessional business practices
I have been trying to complete a short sale with Bank of America for a year and a half quite unsuccessfully. Bank of America has repetedly lost correspondence and information that my real estate agent and myself have submitted. Neither their short sale department, forclosure department or their collections department are in communication with eachother and have had to deal with all three departments. At no time was information in collections retained for further calls and I recieve on average 5 calls per day beginning at 7:00 a.m. and ending around 9:00 p.m. I spoke with a membe3r of the modification department earlier today and this man was incredibly rude and condescending and refused to give me his name on several requests. The only time we were close to closing, Bank of America put the wrong names on the paperwork and 3 1/2 weeks later have still not corrected the matter. During this time, they insisted I resend the original letter of hardship and wanted to completely restart the process because they had passed over some time period restraint. This situation has not yet been resolved.
I am an investor. Can I have my buyers Realtor contact you?
I purchase short sale properties from listing agents and pay them the full bank allowed commission plus my buyer’s Realtor gives him 1% of his commission. We do the short sale negotiating with the bank - is that OK with you?
Once I become the holder of the fee simple title I; then, resell MY property using the same listing agent. In other words the original listing agent gets paid twice on the same property. This can happen in a very short time frame.

I have read the many complaints about Bank of America and realize mine is just one among many. I had banked with them for over 30 years, have good credit and go screwed by them also.
I am wondering if there are lawyers out there who are willing to take the cases against BofA for unfair business practices in class actions.
I have written to the congress people on the finance banking committees and did not receive one response. The average person is not thought of in the bail outs. They keep sticking it to us.
Why are they able to play their games with credit to the average consumer? Why are there no regulations protecting us. At the very least we need to spread to word, start the movment, make our representatives act for us...not the big financial companies who hold all the power.
Well all I have to say is I been banking with bank of america for 5 years now they never told me that transfering money from my savings to my checking would charge me but I found out after I transferd money three times that they do so my savings account is negitive they also told me that when I spend money round it up to the dollar up so if I had 23.75 in checking I actually only had 23 and after a certain period of time they would match whatever was put in there that way not once have I seen a dime of that and then I check my bank account to night cuz I got a email saying insufficant funds and I hadn't used my card and I don't even have checks and it was a check that was processing and they are charging me $35 already and they said I have to pay it by the 24th or ill get charged another $35 its bull
I had the same thing happen to me with Bank of America. The last time I was able to enter my online account it showed I had a minus $874, 430.31 balance. This is impossible. Now I can't even access my online account which is in Dallas, Texas . I live in a foreign country so I can't go to my local neighborhood bank. I have noticed that most of the people that have comments think it's a big joke. I don't. It is very serious.

This in fact happened to a co-worker of mine. He checked his balance and was overdrawn 830, 000. He had 25, 000 in savings which the bank gave back to him, seems there are people who work for BOA who have placed cameras in atms to catch pin numbers. The rest is history. This was on the news but disapeared very quickly. My advise tell everyone you know to close all BOA accounts, cause the feds will do nothing to help you.
Last time i checked every regulation is there to protect the customer.
